The creators of the Apple TV+ show “Servant” faced a setback in court recently as a judge denied their request for dismissal of claims that they copied from a 2013 independent film. The case is now moving forward towards trial.

Apple Inc., writer Tony Basgallop, and executive producer M. Night Shyamalan were unable to prove that they had not seen or used ideas from “The Truth About Emanuel,” according to the US District Court for the Central District of California. Writer and director Francesca Gregorini presented enough evidence of similarity and raised disputes over access, leading the court to decide that a jury should determine the outcome.

District Judge Sunshine S. Sykes’ decision to deny summary judgment means the case will continue to progress. It remains to be seen how this legal battle will unfold as it heads towards trial. Stay tuned for more updates on this developing story.
